又稱為101-476公法，一九七○年的身心障礙教育法案(EHA或91-230公法)，其Part B是經過一九七五年94-142公法的全盤修正，一九八六年的99-457公法變成EHA的 Part H。

到一九九○年美國國會通過101-476公法，將「身心障礙教育法案」名稱改為「身心障礙人士法案」，也就是將The Education of the Handicapped Act(EHA)改為The Individuals with Disabilities Education Act(IDEA)(Yell,1998)。

因此，EHA-Part B就變成IDEA-Part B,EHA-Part H變成IDEA-Part H. 一九九○年的IDEA規定，州政府必須對州內六歲到十七歲的全體身心障礙學生提供特殊教育。

另外，各州政府教育法令如果規定對十八歲到二十一歲身心正常青少年提供教育，則州政府也必須對相同年齡階段的身心障礙青年提供特殊教育；各州政府教育法令如果對三歲到五歲學前兒童提供學前教育，則州政府也必須對三到五歲階段的身心障礙兒童提供學前特殊教育(Ruesch,1996)。

一、 一九九○年IDEA(101-476公法)的架構與各部分全銜 依據Weber(1992)所著Special Education Law and Litigation Treatise一書所附的一九九○年IDEA此一法案內容為依據，IDEA架構可分為八個部分，其架構與各部分全銜如下：(20 U.S.C. 1400-1485)
1. Part A-General Provisions(一般條款)。
2. Part B-Assistance for Education of All children with Disabilities(對全體身心障礙兒童的教育提供幫助)
3. Part C-Centers and Services to meet special Needs of Individuals with Disabilities(為配合身心障礙人士的特殊需求設立各種特殊教育中心並提供服務)
4. Part D-Training Personnel for the Education of Individuals with Disabilities(訓練特殊教育人員)。
5. Part E-Research in the Education of Individduals with Disabilities(特殊教育研究)
6. Part F-Instructional Media for Individuals with Disabilities(對身心障礙人士提供教學媒體)。
7. Part G-Technology, Education Media, and Materials for Individuals with Disabilities(對身心障礙人士提供科技、教育媒體與教材)。
8. Part H-Infants and Toddlers with Disabilities(身心障礙嬰兒與幼兒)。

 二、 一九九○年IDEA(101-476公法)施行細則 依據Ruesch(1996)的見解，一九九○年IDEA最重要的施行細則有兩部分，
一是IDEA－Part B(即IDEA-SUBCHAPTER II)施行細則，其全銜是「幫助州政府辦理身心障礙兒童教育」(Assistance to States for the Education of Children with Disabilities)，
二是IDEA-Part H(即IDEA-Subchapter ⅤⅢ)施行細則，其全銜是「身心障礙嬰兒與幼兒早期介入方案」（Early Intervention Program for Infants and Toddlers with Disabilities）。

 (一) 一九九○年IDEA-Part B施行細則的架構與各部分全銜（34 C.F.R. 300）
1. Subpart A-General(一般規定)。
2. Subpart B-State Plan and Local Educational Ageney Applications (州政府特殊教育計畫與地方教育機構申請特教補助款)。 3. Subpart C-Services(對身心障礙兒童提供教育服務)。
4. Subpart D-Private Schools(對安置在私立學校的身心障礙學生處理規定)。
5. Subpart E-Procedural Safeguards(對身心障礙兒童及其家長提供程序性保護措施)。
6. Subpart F-State Administration(州政府特殊教育行政措施)。
7. Subpart G-Allocation of Funds;Report(特殊經費的分配；報告)。

(二) 一九九○年IDEA-Part H施行細則的架構與各部分全銜(34 C.F.R. 303) 一九九○年IDEA-Part H施行細則其架構分為六個部分，其架構與各部分全銜如下：
1. Subpart A-General(一般規定)。
2.Subpart B-State Application for A Grant(州政府申請早期介入方案補助款)。
3. Subpart C-Procedures for making Grants To States(聯邦政府對州政府提供早期介入方案補助款的程序)。
4. Subpart D-Program and Service Componemts of A Statewide System of Early Intervention Services(全州性早期介入方案與早期介入服務系統的要點)。
5. Subpart E-Procedural Safeguards(對身心障礙嬰幼兒及及家其提供程序性保護措施)。
6. Subpart F-State Administration(州政府辦理早期介入方案的行政措施)。

Individuals with Disabilities Education Act Amendments of 1997（IDEA修正案）
障礙者教育修正案

確認了每個兒童獲得免費和適當的教育權利，包含障礙兒童可與同儕一起受教育、3-21歲教育延伸適當的調整、最少限制環境、和輔助科技設備與服務、指示個別化教學計畫(IEP)、家長參與、合法過程等概念。
